The ULEZ Judicial Review
Four London Councils and Surrey have applied to the high court for a Judicial Review into the proposed expansion of the Ultra Low Emission Zone (ULEZ) London-wide from August 2023.
The coalition of Bexley, Bromley, Hillingdon and Harrow, along with Surrey County Council wanted five grounds to be considered:
- Failure to comply with relevant statutory requirements
- Unlawful failure to consider expected compliance rates in outer London
- The proposed scrappage scheme was not consulted upon
- Failure to carry out any cost benefit analysis
- Inadequate consultation and/or apparent predetermination arising from the conduct of the consultation
On 12th April the Court allowed two of these grounds to be heard but on appeal on 26th May, they allowed a further two grounds to be added. So the four points that will be reviewed are:
- Failure to comply with relevant statutory requirements
- Unlawful failure to consider expected compliance rates in outer London
- The proposed scrappage scheme was not consulted upon
- Inadequate consultation and/or apparent predetermination arising from the conduct of the consultation
With these four grounds, the Councils are in with a good chance of the ULEZ expansion being judged unlawful.
